Trial preparation

Review a witness's examination outline

You want to prepare an examination from the matter's recorded topics and evidence without treating a suggested witness or an assembled outline as counsel's finished plan.

Before you begin

  • A recorded witness and the source material counsel intends to use.

What to do

  1. Open the matter's Trial view. Use Order of proof to find the witness in the intended sequence, or Index and Witnesses to inspect the recorded person. Check identity, role and side before relying on the entry.
  2. Read the examination outline alongside the topics your team recorded. BRON assembles this outline from existing records. It does not use a model to invent examination facts, and an omitted topic may simply be absent from those records.
  3. Open the testimony and documents behind each point. Check the relevant passage in context, including qualifications and competing accounts. A recorded topic is a preparation aid; it does not establish what the witness will say in court.
  4. Review the proposed exhibits and foundation questions for that witness. Decide which points counsel wants to establish and which need further preparation. Keep a suggested sponsor or matching name separate from counsel's decision about who can establish foundation.
  5. If the outline is thin or a person is missing, inspect the underlying witness, topic and evidence records. Retry a failed read before drawing conclusions. Record the missing preparation work for the team instead of filling gaps with assumed facts.

What you should see

Counsel can distinguish recorded topics and sources from questions still requiring preparation, and can see how the witness fits into the intended order of proof.

Limits and unresolved problems

Trial preparation remains limited and other trial tools are in development. The assembled outline reflects recorded material. Counsel decides the examination, supplies legal authority and assesses the witness's knowledge.
