Discovery and production

Review a production package and record its delivery

The team has reviewed documents for production and needs to check the set, prepare the required files and establish what was actually delivered.

Before you begin

  • A defined production set and any related request.
  • The operative production requirements, reviewed coding and an attorney authorized to approve the act.

What to do

  1. Open Discovery and Production. Select the intended production set and related request. Compare its documents, Bates range and recipient with the assignment. If the set needs correction, return to Documents and correct the set before preparing delivery.
  2. Review the operative ESI protocol and the available output format. Check family treatment, required metadata and other negotiated terms. A format listed in an agreement is not evidence that BRON can emit it. Resolve an unsupported format with the attorney before proceeding.
  3. Inspect review coverage, privilege conflicts, withholdings and any missing or unreadable document status. Privileged, work-product, unreviewed and unavailable documents remain blocked. Resolve the cause and recheck the package rather than changing a status merely to remove the block.
  4. Prepare the package and inspect the files and manifest that will leave. Read the confirmation with the attorney, including the exact set, recipient and delivery method. Preparing or downloading a package does not itself establish that the production was sent or served.
  5. After the approved delivery action, read its method-specific result. Provider acceptance, a portal made available and a completed download describe different events. For manual delivery, record what actually happened and retain the supporting evidence. If the outcome is uncertain, inspect the record before repeating the action.

What you should see

The production record identifies the exact package and the evidence returned for its delivery method. Unresolved privilege, review or format problems remain explicit.

Limits and unresolved problems

An application delivery receipt does not decide whether service satisfies the governing rules or agreement. The attorney determines legal sufficiency. A package prepared without delivery is still only prepared.
