Discovery and production

Inspect a possible gap in a received production

A received email refers to an attachment you cannot find, the production has a numbering gap, or Discovery reports an incomplete document family.

Before you begin

  • The received production and its load file, when supplied.
  • Access to the source document behind the finding.

What to do

  1. Open the matter's Discovery area and Their gaps. Confirm which received production the finding concerns. Read any scan limitation or failure before interpreting the list. A scan that could not run is not a finding that the production has no gaps.
  2. Open the finding and the quoted line it relies on. Read the source email beside its attachments or family information. Check whether the reference actually describes an attached file, a separate earlier transmission, or something that was only planned.
  3. For a numbering gap, inspect the load-file convention. A production that assigns one number per document may leave apparent gaps occupied by pages within those documents. Treat the gap as a question until the numbering and family structure support a more specific conclusion.
  4. Compare the finding with material already received elsewhere in the matter. Record the attorney's disposition if the question is resolved or dismissed. Re-running the scan updates open findings; it should not be used to erase the prior decision or its basis.
  5. If the question is unresolved, prepare a focused request or meet-and-confer item naming the production, document and missing material. Preserve an unconfirmed match as unconfirmed in the correspondence. Ask for the material or an explanation without treating the software's finding as proof of withholding.

What you should see

The team has a source-backed question, a documented resolution, or a stated scan limitation. The next request identifies what is missing from the reviewed material and why it was expected.

Limits and unresolved problems

A gap is not proof that anything was withheld. The gap scan refuses productions over 200,000 documents rather than reporting a partial scan as a clean result.
