Documents and sources

Inspect a fact, its sources and its recorded status

A fact appears in an answer or draft, and you need to see who says it, what document it comes from, and whether the matter treats it as disputed or accepted.

Before you begin

  • Access to the matter and the source documents.
  • The fact must be recorded on the matter to have a fact detail view.

What to do

  1. Open the matter's Facts view and select the fact. Read its wording and status before following a source. A recorded assertion may be disputed, admitted or otherwise qualified. Finding it in the record does not resolve the underlying disagreement.
  2. Open Who says so and each available source. Check the named document, its version, the speaker and the surrounding passage. Where a page or passage locator is available, use it to reach the cited material, then read enough context to assess the proposition.
  3. Read Disagreements on this fact. Compare the competing accounts without replacing one with the other just because one is easier to find. If a source cannot be read, record the unresolved check and ask someone with the necessary access to inspect it.
  4. Use Used in to inspect recorded work that relies on the fact. This is useful when reviewing a proposed correction. It is a view of recorded dependencies for that fact, not a representation that every use across the firm has been found.
  5. If the fact needs correction, use the matter's review process and give the source and reason. A proposed correction needs the required attorney decision. After acceptance, inspect affected work that is flagged for review and decide whether its text needs changing.

What you should see

You can state the fact's recorded status, identify the accounts and passages behind it, and distinguish a proposed correction from an accepted change.

Limits and unresolved problems

A source link shows where the statement points. Whether that passage supports the statement remains a review judgment. Recorded dependencies are not a complete inventory of every use.
