Billing and trust

Review a closing statement before approval or signature

A settlement closing statement has been prepared and the firm needs to inspect its gross amount, deductions and client share before approving or presenting that version for signature.

Before you begin

  • The recorded settlement figures, applicable fee terms, costs and lien records.

What to do

  1. Open the matter's Billing and settlement work, then the closing statement. Confirm the matter and statement version. Read the gross recovery and the source of each fee, cost and lien deduction before relying on the net-to-client figure.
  2. Compare the calculation with the firm's recorded terms and supporting entries. Investigate missing sources or amounts that do not balance. Do not add an unexplained adjustment to make the statement agree with a figure someone expected.
  3. Have the responsible attorney review the exact statement before approval or sharing. Read the confirmation carefully: publishing a statement for client review, approving its figures and sending it for signature are different acts with different recorded outcomes.
  4. Inspect the signature status for the version sent. A signature request is not a signed statement. Sending for signature fixes that version; a later change requires a new statement rather than silently altering the document the client was asked to sign.
  5. Review any proposed payees in the trust approval queue separately. Check the bank's actual payment process and receipts through the firm. If a share, approval or signature step fails, inspect its recorded state before retrying and resolve the stated problem.

What you should see

The reviewed statement identifies the basis for its figures and its exact approval or signature state. Any later trust or bank action remains a separate, traceable step.

Limits and unresolved problems

Calculating, approving or signing a closing statement does not pay anyone. BRON records the statement and can propose trust approval work; the firm controls bank payments and counsel determines the applicable requirements.
